Proposed government changes to inheritance laws for cohabiting couples could inadvertently spark more disputes rather than resolve them, according to legal experts. While the intention is to streamline inheritance for unmarried couples, concerns are being raised that the reforms might create a dangerous illusion of security.

Current Inheritance Rules and Proposed Changes

Under existing legislation, if an individual passes away without a valid Will, their estate is automatically distributed to their spouse and children. However, this provision exclusively applies to legally married couples or those in a civil partnership. Cohabiting partners, regardless of the length of their relationship or whether they share children, currently have no automatic inheritance rights.

The government is currently seeking public consultation on extending automatic inheritance rights to cohabiting couples, granting them similar protections to married and civil partners when a Will is absent.

Expert Concerns Over “False Sense of Security”

Lauren Smith, a Partner at Taylor Bracewell Solicitors and a participating solicitor with Will Aid, has voiced significant concerns. “There is a very real danger that reforms like these create a false sense of security,” Smith stated. “People may believe the law will now ‘sort everything out’ for them after death. It won’t.”

Smith elaborated, “In reality, modern families are far too complicated for any default legal framework to deliver the outcome every individual would want.”

Widespread Misunderstanding Among Cohabiting Couples

Research conducted by Will Aid, a national campaign promoting the creation of Wills, reveals a significant gap in understanding. The study found that 68% of cohabiting couples are unaware of the legal implications when a partner dies without a Will. Alarmingly, a quarter of these couples mistakenly believe they will automatically inherit from their partner if they are not legally married or in a civil partnership.

Complexity of Modern Families

Smith further highlighted the complexities of contemporary family structures. “While the government’s consultation seeks to address an important issue, it also highlights just how complicated modern family life has become,” she explained. “The reality is that there is no single legal solution that can accurately reflect every family’s circumstance or every individual’s wishes.”

She pointed to common scenarios such as blended families, individuals with children from previous relationships, business interests, inherited assets, or specific desires regarding the distribution of their estate. “What may be the right outcome for one family could be entirely wrong for another,” Smith cautioned. “Automatic inheritance rights could produce outcomes that are directly contrary to those wishes.”

Defining “Cohabiting Couple”

The practical implementation of the proposed reforms also presents challenges, particularly in defining what constitutes a ‘cohabiting couple’. Smith noted potential difficulties in cases where individuals live together but maintain separate finances, or in situations involving reconciliations after a separation.

The Crucial Role of a Will

Ultimately, Smith emphasized the fundamental importance of a professionally drafted Will. “The uncomfortable truth is that no law can ever know what an individual wanted. The only document that can do that is a professionally drafted Will,” she asserted.

Call for Clarity and Professional Advice

Peter de Vena Franks, Campaign Director at Will Aid, echoed these sentiments. “The fact that nearly seven in ten cohabiting couples do not understand the current law demonstrates how much confusion already exists,” he stated. “The answer cannot simply be to create another set of default rules and hope people read the small print. Every family is different. Every estate is different. Every person’s wishes are different.”

De Vena Franks concluded, “The only reliable way to protect your loved ones is to make your intentions absolutely clear through a professionally drafted Will. By participating in Will Aid, couples can ensure their wishes are clearly documented, giving both partners peace of mind that their loved one will be provided for in the event of their death.”
