MoD Faces Maximum Sanction After Tank Explosion Kills Two Soldiers

The Ministry of Defence (MoD) is facing the most severe sanction available after an explosion involving a Challenger 2 tank resulted in the deaths of two soldiers and serious injuries to two others. The Health and Safety Executive (HSE) has authorized a Crown Censure against the MoD and initiated prosecution proceedings against the defence contractor responsible for the tank’s safety case.

Tragic Incident at Castlemartin Range

The fatal incident occurred on June 14, 2017, at the Castlemartin Range in Pembrokeshire. Corporal Darren Neilson, 31, and Corporal Matthew Hatfield, 27, lost their lives when a projectile from an L30 gun exploded prematurely on a Challenger 2 main battle tank. The blast also caused life-changing injuries to one soldier and injured another.

HSE Investigation and Authorised Sanctions

Following a thorough investigation by its inspectors, the HSE has taken significant action. The executive confirmed that neither the Crown Censure nor the criminal charges represent a definitive finding of guilt at this stage. Instead, they signify allegations following the investigation’s findings.

Crown Censure for the Ministry of Defence

The HSE has authorized a Crown Censure against the Ministry of Defence. This is the highest sanction that can be imposed on a government body. The censure is for alleged failures to ensure the health, safety, and welfare of soldiers, a breach of Section 2 of the health and safety at work act. The MoD, as the ultimate authority, held responsibility for the safety of its personnel and the adequacy of the safety protocols for military equipment.

Prosecution of Defence Contractor

In parallel, the HSE is prosecuting Rheinmetall BAE Systems Land Ltd, formerly known as BAE Systems Global Combat Systems Ltd. This defence contractor was responsible for developing and producing the safety case for the specific tank and gun involved in the explosion. The company faces charges under Section 3 of the health and safety at work act for allegedly failing to ensure the health and safety of individuals not in its direct employment, specifically in relation to the risks posed by the equipment.

Understanding Crown Censure and Prosecution

It is crucial to understand the nature of these actions. A Crown Censure is a formal reprimand issued by the Crown Prosecution Service when it is in the public interest to do so, but a prosecution is not possible or appropriate. For government departments like the MoD, which cannot be prosecuted in the same manner as private companies, a Crown Censure is the maximum penalty available. It signifies a formal acknowledgment of failings identified by the investigating body.

The criminal charges against Rheinmetall BAE Systems Land Ltd are separate legal proceedings. These will follow the standard judicial process, where the company will have the opportunity to respond to the allegations made by the HSE. The authorization of these charges means that the HSE believes there is sufficient evidence to proceed with a prosecution.

The Role of Safety Cases

A critical element in this case is the ‘safety case’ for the Challenger 2 tank and its L30 gun system. This document is a formal compilation of evidence, analyses, and arguments that demonstrates how safety is managed and assured. Rheinmetall BAE Systems Land Ltd was tasked with producing this vital documentation. The HSE’s investigation would have scrutinized the adequacy and accuracy of this safety case, determining whether it appropriately identified and mitigated the risks associated with the equipment’s operation.

The MoD’s ultimate responsibility lay in ensuring that the safety case provided by the contractor was suitable and sufficient, and that its own internal procedures and oversight adequately protected its service personnel. The alleged failure to meet these obligations forms the basis of the Crown Censure.

Next Steps in the Proceedings

Following the HSE’s decision to issue a Crown Censure to the MoD and authorize charges against Rheinmetall BAE Systems Land Ltd, formal hearings will now take place. These proceedings aim to address the alleged breaches of health and safety legislation and to establish accountability for the tragic events of June 2017. The outcome of these hearings will determine the final consequences for both the Ministry of Defence and the defence contractor.

This case underscores the paramount importance of robust health and safety protocols within military operations and the defence industry. The loss of life and severe injuries highlight the critical need for rigorous safety assessments, accurate safety case documentation, and unwavering commitment to personnel welfare.
