Norwegian authorities have seized a Russian research and cruise vessel, the Professor Molchanov, in the Arctic settlement of Barentsburg. The action was taken on behalf of Ukraine’s state energy company, Naftogaz, which is seeking to enforce a multi-billion dollar compensation award against Russia.
Arctic Seizure Sparks Russian Outrage
The vessel was detained late Wednesday in Barentsburg, a coal mining community on the Norwegian Arctic archipelago of Svalbard. Russia’s Foreign Ministry reacted swiftly and with strong condemnation, labeling the seizure an act of “piracy.” Moscow summoned the Norwegian ambassador to lodge a formal protest and vowed to work towards the ship’s release. The ministry stated that Norway’s restrictive measures against Russia in Svalbard, which it claims violate international law, have effectively placed Russian organizations and citizens operating there under a blockade.
Svalbard operates under a 1920 treaty that grants signatory nations, including Russia, the right to establish a presence. Russia argues that Norway’s actions contravene this treaty.
Norway’s Response and Humanitarian Offer
Governor of Svalbard, Lars Fause, confirmed the seizure and stated that Norway is prepared to facilitate the safe return of the ship’s crew and passengers to Russia if they wish to go home. “We are in a dialogue with the Barentsburg leadership and are ready to find ways to safely return people to Russia,” Fause told Norwegian broadcaster TV2.
Norway’s Ministry of Justice clarified that the dispute over the vessel itself is a matter between Naftogaz and Russia, and the Norwegian government is not directly involved in the underlying claim. The seizure was ordered by a district court on Monday, with the governor tasked with ensuring the ship remains immobilized. Russia has the option to request a reassessment of the case by the district court.
The Naftogaz Compensation Claim
The seizure is linked to a significant compensation award granted to Naftogaz. The Ukrainian energy firm has been pursuing Russia since 2016 to recover assets seized by Moscow following the annexation of Crimea in 2014. In April 2023, an arbitration court in The Hague ordered Russia to pay Naftogaz $4.22 billion, plus interest and legal costs, for the expropriation of its properties.
Russia has stated it does not recognize the jurisdiction of the arbitration court in this matter and has refused to pay the award. Sergii Fedorenko, acting CEO of Naftogaz, asserted that Russia cannot evade its legal responsibilities by simply disregarding an international arbitral award. Naftogaz estimates the total amount owed, including accrued interest and costs, has now risen to approximately $6 billion.
The ‘Professor Molchanov’ Vessel
The Professor Molchanov is a 71-meter (233-foot) vessel built in Finland in 1982. It is equipped to accommodate 32 crew members and 52 passengers, featuring amenities such as a library, sauna, bar, and two restaurants, according to Cruisemapper. The ship is utilized for both scientific expeditions and commercial cruises.
The vessel arrived in Barentsburg on Tuesday carrying a group of Russian scientists. News of its seizure only emerged on Wednesday evening. Andrei Gorbunov, editor-in-chief of Komsomolskaya Pravda radio, who was accompanying the expedition, reported that the ship docked without incident and passengers went ashore. He noted that no arrests were made and that daily activities continued as normal, with the ship being prohibited from leaving port.
Legal Avenues and Future Prospects
Clovis Trevino, a partner at the US law firm Covington, which represents Naftogaz, anticipates that Russia will contest the vessel’s arrest in court. “So we need to win another legal battle to be able to auction the vessel and get the money for our clients, which is the ultimate goal,” Trevino told Reuters. She indicated that her firm, along with Norwegian counterpart Wikborg Rein, had been monitoring the ship for several months.
While the Professor Molchanov likely represents only a fraction of the total debt owed to Naftogaz, Trevino described its seizure as a “very meaningful win.” Naftogaz has stated its intention to continue seeking Russian assets globally to satisfy the compensation award, with potential targets identified in jurisdictions including the United States, France, Britain, and Finland, where Russian assets have already been frozen.
Svalbard’s Unique Status
Svalbard, a Norwegian territory since 1925, holds a unique geopolitical position. Situated midway between the North Pole and mainland Europe, its governance is defined by the 1920 treaty. This treaty allows citizens of signatory states, including Russia, to reside and work on the archipelago without requiring visas. Barentsburg is one of two Russian settlements on Svalbard, home to a combined population of 392 residents within the total archipelago population of 2,914, according to Statistics Norway.
