A British father appeared in court in Paphos, Cyprus, on charges related to the tragic death of his young son, who fell from a hotel window. The case, which has garnered significant attention, was adjourned until next week, marking another delay in proceedings that have deeply affected the family. The father, a 37-year-old professional, attended the Paphos District Court alongside his parents, just one day after what would have been his son’s third birthday. He was arrested shortly after the fatal incident on July 12, facing accusations of “causing death through negligence, reckless and dangerous actions.” Prosecutors acknowledged the profound suffering of the father and his family, stating that the state must uphold the law. No plea was entered during the hearing, as the defense requested additional time to prepare. The father could face a prison sentence of up to four years if convicted.

The father’s lawyer, Alexandros Alexandrou, expressed that his client is “not in a good way” and that he must now explain the gravity of a potential sentence and trial to him. This development follows the Cyprus attorney general George Savvides’ rejection of an appeal to drop the case on humanitarian grounds, a decision that reportedly surprised the defense. The argument for dropping the case centered on the lack of public interest in continuing a prosecution that would only exacerbate the family’s trauma.
The tragic event occurred at the five-star King Evelthon Hotel near Paphos. According to reports, the father briefly placed his toddler son on a windowsill while waiting for a lift, unaware that the window was open. The child subsequently fell from the fourth-floor window, a fall of approximately 33 feet. He was pronounced dead upon arrival at Paphos General Hospital. The father, who has not been publicly named, was initially detained for eight days without charge, an experience described by local media as particularly harsh. Investigations focused on the father, despite the hotel’s history of incidents.
Family’s Ordeal and Hotel Safety Concerns
During his initial detention, the father had to inform his five-year-old daughter of her brother’s death via FaceTime. His wife and daughter, who returned to the UK in late July, are being supported by friends and family. The lawyer highlighted the daughter’s need for her father, emphasizing his importance to her well-being. He also referred to the father as a “victim of his own so-called ‘carelessness’,” underscoring the complex emotional and legal landscape.
Toxicology reports indicated a minimal amount of alcohol in the father’s blood, equivalent to one or two drinks. Following formal charges, he was required to post bail totaling $30,000 (£25,750) and was initially prohibited from leaving Cyprus. This travel ban was temporarily lifted for one month to allow him to attend his son’s burial. Friends have expressed concern about the family’s financial stability and the father’s ability to return to his job, given the ongoing legal proceedings.
A family member described the deceased toddler as a “truly special, easy-going little boy who brought so much joy to everyone around him,” whose “infectious smile, warm cuddles and kind heart” are deeply missed.
Hotel’s Safety Record Under Scrutiny
An inspection of the King Evelthon Hotel revealed that the fourth-floor window through which the toddler fell remained open. While UK health and safety regulations typically mandate restricted openings for such windows to prevent falls, Cypriot law requires only that the window be above a ledge of at least 1.1 meters, a standard the hotel meets. The resort’s safety record has faced increased scrutiny due to multiple fatalities involving British tourists. In July 2022, 21-year-old Ben Woods drowned in the hotel’s pool. The following year, six-year-old Ruaridh Nairne also drowned at the same hotel. Reports also indicate another death at the resort in 2024.
The next court hearing is scheduled for Tuesday, the 22nd, with the father expected to remain in Cyprus until then. The ongoing legal process continues to place immense strain on the family as they navigate grief and legal challenges.
