Tensions between unions and mining giant BHP have escalated following an incident at BHP’s Port Hedland operations where union officials were removed from the site. The dispute centers on an alleged violation of right-of-entry procedures during a visit by representatives from the Electrical Trades Union (ETU) and the Australian Workers’ Union (AWU).

Union Claims Illegal Removal from Site

The ETU stated that three elected union representatives were escorted off the premises by security guards on Thursday. According to the union, the officials were engaged in a lawful right-of-entry visit when a site manager instructed them to sit down in a room that reportedly lacked any seating facilities. When the representatives did not comply with the order to sit in a non-existent space, they were removed.

Following their removal, the union officials were met by police outside the terminal. The ETU has strongly refuted any wrongdoing, asserting that its officials conduct visits in a “civil, peaceful and efficient” manner. The union has accused BHP of fabricating a “disgraceful smear” against individuals who were allegedly prevented from carrying out their duties.

Adam Woodage, the ETU’s WA state secretary, described the incident as a “flagrant breach of the Fair Work Act, and of International Labor Organization conventions on freedom of association.” The union intends to seek legal recourse by applying to the Federal Court for redress regarding what it deems an illegal act.

BHP Cites ‘Aggressive Behaviour’ and Workplace Standards

BHP has countered the union’s claims, stating that the representatives exhibited “aggressive behaviour” towards a female BHP employee who had asked them to adhere to the site’s directives. A spokesperson for BHP emphasized that all individuals entering BHP sites are expected to comply with established rules and regulations.

“Aggressive behaviour is never tolerated in our workplaces,” the BHP spokesperson stated. “In the interests of maintaining a safe and respectful workplace, we have a responsibility to uphold standards of behaviour which are respectful of everyone on site.” The company maintains that its actions were necessary to uphold standards of behaviour and ensure a safe environment for all personnel.

Western Australia Police confirmed their attendance at a BHP facility on Thursday morning. However, they reported no direct interactions with union members, no charges being laid, and no ongoing investigations related to the incident.

Broader Industrial Dispute Context

This confrontation occurs against the backdrop of an ongoing industrial dispute between BHP and various unions at the Port Hedland operations. Negotiations have been protracted, and the port has experienced several strikes of varying intensity in recent times.

The incident also follows a separate report of a serious workplace injury at BHP’s Port Hedland site on the same weekend that some unionized staff participated in a work stoppage. In that incident, a contractor sustained a crushed arm resulting in a broken elbow. Reports indicate this accident occurred in an area not affected by the union’s industrial action, during a scheduled maintenance shutdown.

Safety Investigation Underway

Both BHP and WorkSafe, the relevant regulatory body, have confirmed that the contractor injury is under investigation. This includes both an internal review by BHP and an external examination by WorkSafe.

“Safety is paramount across all BHP operations,” a BHP spokesperson reiterated. “We investigate all onsite injuries to determine the cause and establish improved work practices if needed.” The company stressed its commitment to safety and to thoroughly investigating all workplace incidents to prevent future occurrences.

Port Hedland Significance

BHP maintains a substantial operational presence in the Town of Port Hedland, utilizing its facilities for the export of iron ore. The ongoing industrial relations issues and safety concerns highlight the critical nature of maintaining stable operations and robust safety protocols at this key export hub.

The Fair Work Commission has acknowledged the situation but declined to comment, as the matter is expected to proceed to the Federal Court. The legal proceedings are anticipated to bring further scrutiny to the rights and responsibilities of both employers and unions within the framework of Australian industrial law.
