A bid to halt the sentencing of celebrity agent Ralph Carr, who was found guilty of rape last month, has been made by his defence team in a rare legal maneuver. The application, known as a “stay of proceedings,” seeks to pause the sentencing process, allowing Carr to pursue an appeal and potentially seek bail. Prosecutors have strongly opposed the move, characterizing it as an attempt to garner media attention and delay justice.

Defence’s Rare Legal Move

Dermot Dann KC, representing Ralph Carr, argued before County Court Judge Frank Gucciardo that the sentencing, scheduled for the following week, should be postponed. Dann described the jury’s guilty verdict as a “miscarriage of justice,” stating it was the most significant he had witnessed in his 35-year career. He urged the judge to reconsider the verdict, suggesting that anyone comfortable with it had lost sight of the meaning of justice.

The defence’s application for a stay is an unusual step, typically employed in exceptional circumstances. If granted, it would pave the way for Carr to apply for bail while awaiting a legal challenge in the Court of Appeal. Dann referenced historical cases involving capital punishment in Victoria, including Ronald Ryan, the last man to be hanged in Australia, and Robert Tait, whose death sentence was stayed, to underscore the gravity of the situation and the potential for a profound injustice.

“Most Obvious Miscarriage of Justice”

Dann passionately articulated his concerns about the jury’s decision, particularly in light of the complainant’s testimony. “Anyone who was in court who saw and heard the complainant give evidence in this trial should be very, very concerned; very, very uncomfortable about the guilty verdicts,” he stated. He further emphasized that the jury’s decision should be a cause for significant unease among those who witnessed the proceedings.

The defence outlined 16 specific points of evidence they intend to challenge, highlighting alleged inconsistencies in the complainant’s account of the night of the assault and other related events. This detailed presentation aimed to portray the trial’s outcome as flawed and warranting further scrutiny.

Prosecution’s Strong Opposition

Prosecutor Matthew Fisher vehemently opposed the defence’s application, dismissing it as an “inappropriate” and “political and emotional” speech designed to attract media attention. Fisher argued that the jury, despite being aware of certain “issues” with aspects of the complainant’s evidence, had reached its verdict of guilt beyond a reasonable doubt.

“Your honour should not entertain the stay application,” Fisher urged the judge, emphasizing that the jury’s decision was based on the evidence presented and their assessment of its credibility. He suggested that the defence’s application was a tactic to circumvent the established legal process and unduly influence public perception.

Jury’s Verdict and Judicial Perspective

Judge Gucciardo acknowledged the defence’s arguments but noted that Carr was not the first person convicted to maintain their innocence. He stated that his role was not to re-evaluate the evidence that the jury had already considered. The judge commended the jury for their diligence, describing them as “very conscientious” and acknowledging the thoroughness of the defence’s cross-examination of the complainant.

“The whole process was exactly as it should have been,” Judge Gucciardo remarked, indicating his confidence in the jury’s deliberations and the fairness of the trial. He suggested that the proceedings had followed the appropriate legal protocols.

Carr’s Mental Health and Sentencing Implications

During the proceedings, Carr became visibly distressed as his legal team detailed his mental health struggles and history of suicide attempts. Dann described Carr as being in “a living hell” while held in isolation in a prison cell for 23 hours a day. The defence argued that these factors should be considered in the context of the ongoing legal challenge and potential pre-sentencing detention.

However, the prosecution urged caution regarding the psychiatrist’s evidence on Carr’s mental health, suggesting it contained a “great deal of speculation.” Fisher implied that the defence was attempting to create a narrative around Carr’s well-being to influence the court’s decision regarding bail and sentencing.

Next Steps in the Case

The pre-sentence hearing is scheduled to continue the following day, with prosecutors expected to present further arguments regarding the nature of Carr’s offending and its impact on the victim. If Judge Gucciardo refuses the stay application, Carr is likely to face sentencing the subsequent Thursday.

Should Carr be sentenced before his appeal is heard, he could spend a significant period incarcerated. The legal challenge in the Court of Appeal could take months to resolve, meaning Carr might remain in custody during that time, regardless of the outcome of the appeal itself.
