A senior doctor has raised serious concerns regarding patient safety and policy adherence at a National Health Service (NHS) trust, alleging that a transgender patient, described as having a beard, was admitted to a women’s psychiatric ward. The consultant psychiatrist, identified only as “Dr A” to protect her identity, claims this situation put vulnerable female patients, including survivors of sexual assault, at risk.

Allegations of Policy Violations and Patient Harm

In a formal tribunal claim filed against the Greater Manchester Mental Health NHS Foundation Trust, Dr A asserts that transgender patients are being granted access to sensitive areas within the female ward, such as shower facilities. She contends that the trust’s current policies on “delivering single sex accommodation,” which permit transgender patients to use bathing and lavatory facilities aligned with their gender presentation, are in conflict with the law.

This assertion follows a landmark Supreme Court ruling in April of the previous year. The court determined that the terms “woman” and “man” within the Equality Act 2010 specifically refer to biological sex. Dr A alleges that her repeated inquiries to the trust about aligning their policies with this judgment have been met with significant delays, resistance, and even suggestions that the ruling might be contested at the European Court of Human Rights.

Incident on the Female Ward

Dr A claims that the transgender patient in question was admitted to the female ward subsequent to the Supreme Court’s decision. She recounted a conversation with a male colleague on the ward who described the situation: “He said that there had been a man with a beard and full male genitalia who had been exposing himself to female patients and they were unhappy,” Dr A stated. The colleague reportedly asked, “But what can you do about it?”

Further elaborating on the alleged incident, Dr A claims a ward manager later confirmed that a transgender woman had indeed been admitted to the women’s ward after the Supreme Court ruling. According to Dr A, the patient was initially removed following complaints but was subsequently readmitted after intervention from the trust’s management. The ward manager reportedly drew a stark contrast between this situation and potential security breaches involving cisgender men:

  • The manager explained that the male and female wards are connected by a corridor.
  • If a cisgender man were to wander into the female ward, a thorough investigation would be initiated.
  • However, if that same individual identified as a woman, the manager indicated that no action would be taken.

Broader Concerns Regarding Staffing and Intimate Care

Beyond the specific incident, Dr A has voiced broader concerns about the potential implications of the trust’s policies. She worries that these policies could permit biologically male staff members who identify as women to provide intimate personal care to female patients. This could include supervising patients during personal hygiene activities, such as showering or shaving, raising significant privacy and safety issues for vulnerable individuals.

Formal Grievance and Trust Response

In June of the current year, Dr A submitted a formal grievance concerning the trust’s alleged non-compliance with the Supreme Court ruling. The grievance was partially upheld, and the panel recommended several actions. These included a review of the relevant policies and staff training, the establishment of clear timelines for policy updates, a clarification of the distinction between biological “sex” and “gender identity,” improved communication regarding single-sex facilities, and a review of the “transitioning at work” policy.

Delays in Policy Updates and Guidance

Despite the Supreme Court ruling over a year ago, Dr A alleges that the Greater Manchester Mental Health Trust has not yet amended its key policies. She further claims that the trust continues to admit biologically male patients to female psychiatric wards. This situation is occurring amidst broader delays in the publication of updated NHS guidance on single-sex accommodation. Following the Supreme Court’s decision, NHS England announced a review and pledged to issue revised guidance promptly, but these updates have faced repeated postponements.
