Senior Traffic Warden Dismissed for Misusing Disabled Badge

A senior traffic warden, tasked with enforcing regulations on the misuse of disabled parking badges, has been dismissed from his position. The termination followed an incident where he was found to be using his deceased mother’s blue badge to facilitate his own shopping trips.

Dinesh Patel, who possessed two decades of experience as a parking enforcement officer, was discovered to be in breach of the very blue badge regulations he was responsible for upholding. An employment tribunal heard that Mr. Patel displayed his late mother’s blue badge in his vehicle to avoid parking fees while he went about his personal errands.

Tribunal Proceedings and Ruling

Mr. Patel, formerly employed by the London Borough of Harrow, characterized his actions as a “silly mistake.” However, the council ultimately decided to terminate his employment, citing that he “should be leading by example.” He subsequently initiated legal proceedings against the council, alleging unfair dismissal. Nonetheless, an employment tribunal has dismissed his case, ruling that his extensive experience in his role meant he was fully aware of the rules and regulations surrounding disabled badges.

An employment judge remarked that Mr. Patel’s “lengthy service meant he should have definitely known better.”

Background and Offence

The Watford Employment Tribunal was informed that Mr. Patel began his career as a Civil Enforcement Officer for the London Borough of Harrow in December 2001. He was promoted to the position of Senior Civil Enforcement Officer in August 2019. His responsibilities included the critical duties of “monitoring, reporting and enforcing the misuse of disabled blue badges” and providing testimony in court for both criminal and civil infringements.

Mr. Patel’s mother had been a valid blue badge holder, with her badge expiring in August 2021. Tragically, she passed away three months prior to the badge’s expiration date.

On September 20, 2021, Mr. Patel received a Penalty Charge Notice after being observed using his late mother’s blue badge. Mr. Patel contended that his aunt was present in the vehicle with him at the time, and that he had left the car to shop after parking. He claimed the badge was displayed by his aunt, who later departed the vehicle. He also stated his uncertainty regarding parking payment requirements during the COVID-19 pandemic.

Disciplinary Action and Dismissal

In May 2022, Mr. Patel pleaded guilty in Magistrates Court to the wrongful use of a disabled person’s badge and was subsequently fined. Gary Cooley, his manager, became aware of the offense and convened a disciplinary meeting. During this meeting, Mr. Patel explained that various individuals had access to the vehicle and that he would often have the blue badge displayed on the dashboard.

Employment Judge Nathaniel Caiden noted Mr. Patel’s explanation that this was a “silly mistake” and that he had not anticipated the matter escalating.

Following the disciplinary hearing, the council concluded that Mr. Patel had committed gross misconduct and decided to dismiss him. The dismissal letter stated: “Given your role as a ‘Senior Civil Enforcement Officer’ and your tenure at Harrow Council of over 20 years, you should be leading by example and ensure that any matters relating to fraud would be disclosed to Management at the earliest opportunity.”

Final Ruling on Unfair Dismissal

Judge Caiden ruled that the dismissal was not unfair. He stated, “Whilst you have maintained that it was not you who displayed the disabled parking badge, you are responsible for this action as the vehicle is registered to your name.” While expressing sympathy for the personal loss Mr. Patel had experienced, the judge pointed out that four months was a sufficient period to have returned the disabled parking badge.

The judge reiterated that Mr. Patel’s extensive experience in his field meant he “should have definitely known better.” He further emphasized the “particularly strong relationship between the criminal conviction and [Mr Patel’s] job,” concluding that Mr. Patel “should therefore have known of the position and was in fact responsible for enforcing it.”
