NSW Coroner Demands Stricter Gun Laws After Yamba Murder-Suicide

Magistrate Teresa O’Sullivan, the NSW Coroner, urges mandatory reporting by doctors on patients with firearms amid concerns over their mental health following a tragic murder-suicide in Yamba.

On June 1, 2023, Wayne Smith, 58, fatally shot his 15-year-old son Noah before turning the gun on himself at their home on the NSW north coast.

Court evidence reveals Wayne’s firearms license, previously suspended due to mental health issues, was restored just six months prior to the incident.

Complex Father-Son Bond

The inquest highlights a deep mutual love between father and son, complicated by Wayne’s worsening mental health. “Wayne’s deteriorating mental health necessarily affected Noah,” Magistrate O’Sullivan stated. “At times, he accepted responsibilities far beyond what would be expected of a young person.”

Noah led an active, fulfilling life as a cherished son, grandson, and friend. Unlike typical filicide cases, no prior threats or mistreatment emerged.

A combination of stressors severely impacted Wayne’s mental state leading up to the shootings.

Key Recommendations

Magistrate O’Sullivan issues seven recommendations to NSW Police Minister Yasmin Catley and Police Commissioner Mal Lanyon, including:

  • A legal requirement for doctors to notify police about patients possessing firearms who raise mental health concerns.
  • Encouragement for general practitioners to ask patients about firearm ownership.
  • Mandatory mental health risk assessments by a doctor and psychologist for license applicants with a history of suicidal ideation.
  • Stricter scrutiny of evidence for firearms licenses used in recreational hunting or vermin control by the NSW Police Firearms Registry.

“This was an important inquest, and some important recommendations have been made as a result,” Magistrate O’Sullivan noted.

The NSW Police Minister and Commissioner have received requests for comment.

Tribute to Family

Magistrate O’Sullivan commended the family and friends for their composure during the proceedings. “I offer my sincere condolences to Noah and Wayne’s family and friends for their tragic loss,” she said. “Their grace and dignity throughout these proceedings were remarkable.”
