A groundbreaking Australian space venture, once lauded as the nation’s answer to SpaceX, has been ordered to pay its former chief executive $2.3 million following a contentious legal battle. The company, Equatorial Launch Australia (ELA), and its group chief executive, Michael Jones, were found to have breached contract terms with former CEO Carley Scott.

Court Upholds Former CEO’s Contractual Rights

The Federal Court of Australia ruled in favor of Ms. Scott on Wednesday, deeming her evidence of breach of contract to be both credible and truthful. Ms. Scott, an Order of Australia Medal recipient, had sought nearly $5 million after her termination, alleging a significant breach of her employment agreement.

ELA has since entered voluntary liquidation, with a report to creditors filed with the Australian Securities and Investments Commission (ASIC). An investigation into the company’s operations is reportedly ongoing.

Accusations of Racism and Bullying Surface

The civil trial last year saw Ms. Scott level accusations of bullying and racism against Mr. Jones. While Mr. Jones denied these claims and the Federal Court made no findings of personal misconduct against him, the allegations cast a shadow over the company’s operations.

Ms. Scott detailed alleged instances of ‘unwarranted performance criticism in an unreasonable manner,’ including the raising of ‘baseless or trivial concerns’ and attempts to ‘humiliate, embarrass or discredit’ her publicly. She further claimed Mr. Jones frequently engaged in unreasonable conduct, such as excluding her from meetings and speaking to her rudely.

Alleged Discriminatory Remarks

Court documents revealed specific alleged remarks made by Mr. Jones. On one occasion, he reportedly characterized Ms. Scott as “left-wing” and a “socialist” for supporting Indigenous Australians. Further comments attributed to Mr. Jones included sentiments like, “there’s too much spending on Aboriginal people, they get enough and are still crying poor” and that “if you mother them, you just create more mothers.”

Ms. Scott also alleged that Mr. Jones made disturbing comments directed at women. She reported him saying, “You’re part of the school of women club.” He allegedly went on to question why “so many women get murdered before and after [Family Court cases]? It’s the frustration the guys have that they’re getting screwed.”

According to Ms. Scott’s claims, her boss recounted receiving legal advice approximately 25 years prior on how to treat women during divorce proceedings. The alleged advice, as described in court documents, was to “Make it very loud and very public, but beat your wife to death.” He reportedly added that doing so and claiming “temporary insanity” would be understood due to the stress, with the narrative being that “she drove you crazy.” Ms. Scott stated that this advice had disturbed her at the time, but Mr. Jones allegedly described it as “Absolutely genius” from his current perspective.

Company’s Ambitions and Downfall

ELA had been central to Australia’s space ambitions, successfully launching NASA’s first commercial space mission from the Arnhem Space Centre in the Northern Territory in 2022. This facility, situated on Aboriginal land leased from the Gumatj clan near Nhulunbuy, was a significant development, built with the collaboration of local Indigenous owners.

The company had countered Ms. Scott’s claims, asserting her contract was never valid and that she had opted for an employee share plan instead of contractual entitlements. Mr. Jones had also initiated a counterclaim, accusing Ms. Scott of altering contract documents, but later withdrew this legal action.

Vindication for Former CEO

Imogen Szumer, a Senior Associate at Maurice Blackburn who represented Ms. Scott, stated that the Federal Court’s decision served as a complete vindication for her client. “This is a complete vindication of Carley Scott and a testament to her resilience through complex and hard-fought litigation,” Ms. Szumer commented.

Ms. Szumer highlighted Ms. Scott’s pivotal role in ELA’s journey, from its inception as a startup to securing the contract for NASA’s first commercial spaceport launch outside the United States. She emphasized the close working relationship with the Traditional Owners of East Arnhem Land throughout this process.

“After personnel changes in 2021 and the subsequent termination of our client’s employment, ELA refused to honour the contractual benefits promised to Ms. Scott,” Ms. Szumer added. “Our client was subsequently subjected to serious and unfounded allegations by ELA. Many of these claims were abandoned by ELA in the days and weeks before the trial, and the remaining allegations have now been rejected by the Federal Court. The court accepted Ms. Scott’s evidence and found that her contractual rights must be honoured.”

Impact on Australia’s Space Sector

ELA’s initial launch was celebrated for its scientific contributions, including the deployment of an x-ray quantum calorimeter to study interstellar x-rays and provide data on the cosmos. The company’s subsequent liquidation and the legal proceedings mark a significant setback for Australia’s burgeoning commercial space industry.
