A woman convicted of damaging her neighbor’s wisteria and assaulting her with a crutch violated her restraining order moments after the judge imposed it.
The Incident Unfolds
On December 17, Atidel Boutara Cook damaged a wisteria plant owned by her upstairs neighbors, Pei Wong and Louis Scott, in their Victorian home on Stanhope Gardens, Tottenham, north London. Mr. Scott witnessed Cook cutting down the plant and pulling out others upon returning from work.
When confronted, Cook shouted obscenities, including ‘f*** you, nasty people.’ Ms. Wong filmed the altercation, capturing Cook outside their front door with large garden shears. As Mr. Scott remarked, ‘This is really horrible, you doing this,’ the situation escalated. Cook grabbed Ms. Wong’s phone, screamed abuse, and struck her once on the forehead and twice on the chest with her crutch.
Court Conviction and Sentencing
Highbury Magistrates’ Court convicted Cook of criminal damage on Wednesday. District Judge Denis Brennan described her actions as making the lives of Ms. Wong, Mr. Scott, and potentially their children a ‘misery.’ He noted ongoing interference, such as nighttime banging that disrupts sleep.
In her victim impact statement, Ms. Wong expressed feeling trapped, intimidated, anxious, and emotionally exhausted in her home, prompting her to install CCTV. The court owns the freehold and has resided above Cook for two decades with minimal prior interaction.
Cook received a 12-month community order with 15 rehabilitation activity requirement days, a £500 compensation payment to the homeowners, and a five-year restraining order prohibiting direct or indirect contact with the couple, including through their children. An exemption allows communication via solicitor for building issues.
Instant Restraining Order Breach
Minutes after confirming she understood the order with ‘absolutely, yep,’ Cook peered toward the public gallery where the couple sat and blew a kiss, asking, ‘Happy?’ As she exited the courtroom, she called out, ‘I will send it to you in one go, so you can go on holiday.’
Judge Brennan immediately warned, ‘I warn you Ms Boutara Cook that that is immediately a breach of the restraining order.’ He stated that police involvement would be determined later.
Judge’s Remarks on Neighbor Disputes
Judge Brennan emphasized, ‘Living in accommodation, whether it’s in London or anywhere, should be something that gives people safety, gives them a sense of wellbeing and a sense of which they can lead a happy and ordered life.’
He added, ‘Your behaviour prior to and on December 17 – and if I understand matters correctly, since December 17 – has made the lives of Mr Scott and Ms Wong, and I infer, their children, a life of misery. That is not fair. That is not appropriate.’
